Online Uncontested Divorce in Alabama: How the Process Works

You can start an Alabama uncontested divorce from home, but an online intake form is only the beginning. A qualifying case still requires an agreement, properly prepared and signed documents, filing in the appropriate court, and a judge’s final order.

1. Confirm that every issue is agreed

Both spouses must agree on property, debts, any alimony, and all other terms. If there are minor children, the agreement also needs to address custody, parenting time, child support, insurance, and related expenses. Court approval is still required. If negotiations remain, ask about divorce and custody representation before choosing a flat-fee package.

2. Start with the right intake option

3. Confirm jurisdiction, fees, and the engagement

Living outside Alabama does not automatically prevent a case here, and being stationed or temporarily present here does not answer every jurisdiction question. Under Alabama Code § 30-2-5, when the defendant is a nonresident, the filing spouse must have been a bona fide Alabama resident for the six months immediately before filing; that residence must be alleged and proved. Tell counsel about both spouses’ residences and any other court proceedings.

4. Gather, review, and sign the documents

Prepare a list of assets and debts, income information, relevant account statements, existing orders, and a written summary of agreed terms. Use our Alabama divorce paperwork checklist. The firm will explain the required signatures, notarization, and method for returning documents. Do not assume every document can be signed electronically.

5. Filing and court review

Alabama’s minimum waiting period runs from filing the summons and complaint. The court cannot enter the final divorce judgment until 30 days have expired. This is a minimum, not a promised completion date. Apex Law’s working estimate for a complete, fully agreed case is approximately 45–60 days after the required papers are signed, assuming prompt filing and court review.

The judge may request additional information or an appearance. Remote intake therefore does not guarantee a divorce without any courthouse visit. Ask how your county’s requirements affect your case, and obtain a copy of the final judgment before treating the divorce as complete.

Who does the attorney represent?
