What does contempt mean in an Alabama family case?
Alabama Rule of Civil Procedure 70A governs contempt proceedings arising from civil actions. Its definition of civil contempt involves a willful, continuing failure or refusal to obey a lawful court requirement that can still be complied with. A missed obligation does not automatically establish contempt.
For constructive contempt, the rule provides for a petition describing the essential facts, process, and notice of a hearing. The court decides whether contempt occurred and what relief is appropriate. Filing a complaint does not automatically result in an arrest, payment, or a particular sanction. If you receive a petition or hearing notice, promptly obtain advice and follow the court's instructions.
