Can One Lawyer Represent Both Spouses in an Alabama Divorce?

An uncontested divorce does not mean both spouses have the same lawyer. At Apex Law, the firm represents the spouse who retains it. The other spouse can obtain independent legal advice before signing an agreement or court papers.

Agreement does not eliminate separate interests

Spouses may agree that they want a divorce while having different interests in the home, debts, retirement, support, or parenting arrangements. Even when terms appear settled, each person needs to understand what the documents require and which rights may be affected.

Alabama Rule of Professional Conduct 1.7 addresses conflicts of interest. Its comments recognize that one lawyer may not represent opposing parties in litigation. Signing a consent form is not a general solution that turns one spouse’s divorce attorney into counsel for both.

What one spouse’s lawyer can do

Within the engagement, the retained spouse’s lawyer can advise that client, prepare documents reflecting agreed terms, communicate about the proposed documents, and submit the required case materials. The other spouse’s participation in signing those documents does not create an attorney-client relationship with the firm.

Under Rule 4.3, a lawyer dealing with an unrepresented person must not imply that the lawyer is disinterested and must correct misunderstandings about the lawyer’s role. The lawyer also must not give that person legal advice other than advice to obtain counsel when the applicable conflict conditions exist.

Should the other spouse have independent review?

Independent review can help a spouse assess the effect of a proposed property division, debt allocation, support term, retirement provision, or parenting arrangement. It is particularly useful when one spouse has more financial information, terms are unclear, or someone feels pressure to sign. A lawyer for the other spouse can identify concerns before the paperwork is final.

Ask directly: “Who is your client, and are you giving me legal advice?” If you are the unrepresented spouse, do not assume that a helpful explanation of the filing process is advice about whether the deal protects your interests.

What if independent review changes the agreement?

Pause drafting or signing while the issue is resolved. Apex Law’s standard uncontested divorce package requires full agreement before drafting and includes up to two minor revisions. Disputed terms or more than two minor revisions fall outside that package; continued representation requires a separate contested-matter retainer and hourly agreement.

  • Which spouse will the firm represent?

  • What services and revisions does the fee include?

  • How will the other spouse receive and review the proposed documents?

  • What happens if a term changes or a dispute appears?

  • Does a retirement order, existing case, or post-judgment issue require separate work?
