Attorney Neil E. Fulsang · Apex Law LLC

A driver was stopped in traffic, wearing a seat belt and signaling a left turn, when a pickup struck the vehicle from behind and pushed it off the road into a ditch. Apex Law secured the at-fault driver’s $25,000 bodily-injury policy limits. Initial offer? Less than $4,000. Do you end up making more with an attorney? In every case we’ve seen, yes.

Making the collision clear

Attorney Neil Fulsang’s demand package brought together the client’s account of the rear end crash, the crash information sheet, photographs of the damaged vehicle, and an illustrative diagram. Each served a purpose: explaining where the vehicles were, how the impact occurred, and how the client’s vehicle came to rest off the road.

The diagram below comes from that demand package. It illustrates the account presented in the claim; it is not an accident reconstruction or a scale drawing.

Vehicle 1 represents the client’s stopped vehicle; Vehicle 2 represents the approaching vehicle. Counsel’s illustration, not to scale. Positions and distances are approximate.

Showing the impact beyond the repair bill

The claim also documented what happened after the crash. The client underwent an emergency evaluation and reported weeks of pain, difficulty with ordinary movements, interruptions to recreational activities, and anxiety when stopped in traffic.

Apex’s presentation distinguished the client’s own description of symptoms from the medical billing records. It focused on the harm supported by the available information, without claiming permanent injury, future treatment, or lost wages.

Securing the available liability limits

Apex filed suit, pursued the liability claim, and secured a settlement for the other driver’s $25,000 per-person bodily-injury limit. The check shown above documents that recovery. The settlement resolved the liability claim without an admission of liability.

The firm also submitted a separate demand for benefits under the client’s own underinsured-motorist coverage. That request is distinct from the $25,000 recovery shown here; no additional payment is represented in this case result.
